Obtaining An FFL – 5 Ways To Get Denied
We give you the 5 easiest ways to get a denial when getting an FFL (Federal Firearms License), whether it’s a Type 1 or a Class 3 (SOT).
1. The number one problem with getting your FFL is making sure you’ll have your business in a properly zoned location.
Every community is different.
Go to the city zoning department and find out clearly from the person in charge what exactly are the rules and regulations regarding having a business at your home or any other location.
Make sure you understand the ATF definition of business premises. Your actual business location must comply with BOTH the ATF and your community’s zoning laws or your FFL application may be denied.
2. Another thing that can make you deny is not clearly identifying what you intend to do. Are you going to do repairs on firearms? Are you an expert in a field and intend to make assessments of your business niche? If so, these things can really affect the outcome of your FFL application. You must define exactly what you intend to do under federal firearms regulations. This stipulates which type of FFL you must acquire.
3. You must follow regulations on safe storage of firearms and safety devices. You can’t just put guns on racks, have a locked front door or maybe a metal frame over the entrance and call it secure.
The ATF provides clear definitions of what it calls “secure firearms storage or safety devices.” Remember that in addition to complying with federal law, you will have your own cash tied up in your inventory, so secure storage is absolutely essential.
Also remember that an ATF officer will visit you for a face-to-face interview and assess your security arrangements. FFL denial is possible if your security does not meet ATF requirements.
4. Failure to complete your application correctly in every detail is another reason for an FFL being refused. When the app says: “Last name, first name, and middle initial”, that’s exactly the order in which to enter the information.
Review each document and make sure you have signed or initialed each place if necessary. For example, question 27 “Applicant Certification” requires you to initial each box.
Be sure to answer each question honestly. Falsifying any part of the application will result in FFL denial, possibly a permanent denial.
5. Make absolutely sure that you have both sets of fingerprints for each person listed on the application and on the correct form provided by the ATF. Otherwise, petty snafus like these will see your FFL application denied and possibly land you in a lengthy appeal process.
Avoiding these 5 common mistakes will ensure you get your Federal Firearms License (FFL) and lead to big savings and easier gun transactions. For more help with obtaining an FFL, please see the Authors Bio Box.
